These terms and conditions govern the mutual rights and obligations of Eco Vehicle s.r.o. as the seller (the “seller”) and a natural person who, as a consumer, concludes a purchase contract outside the scope of their business activity or outside the scope of the independent exercise of their profession (the “buyer”) through the web interface located on the website available at www.ecovehicle.cz (the “online shop”). If the buyer states their company identification number in the order, the buyer acknowledges that they are considered a business (entrepreneur) in the contractual relationship with the seller and that the rules applicable to consumers do not apply to them.

The provisions of the terms and conditions form an integral part of the purchase contract. Any deviating arrangements in the purchase contract take precedence over the provisions of these terms and conditions.

The purchase contract and these terms and conditions are drawn up in the Czech language. The online shop is also operated in an English language version; if a translation of the text of the purchase contract or of these terms and conditions is made for the needs of the buyer, then in the event of a dispute over the interpretation of terms, the interpretation of the purchase contract and of the terms and conditions in the Czech language shall prevail.

The seller delivers goods to the Czech Republic, to Slovakia and to the other Member States of the European Union. Delivery to Cyprus, Malta, the Canary Islands, the Balearic Islands, the Azores and Madeira, to Ceuta and Melilla and to countries outside the European Union is possible by individual agreement.

II. INFORMATION ON GOODS AND PRICES

The online shop operated by Eco Vehicle s.r.o. focuses mainly on the sale of electric scooters, spare parts and complementary products for electric scooters, and on related servicing.

Information about the goods, including the prices of individual goods and their main characteristics, is given for each item in the catalogue of the online shop. The prices of goods are stated inclusive of all taxes (e.g. value added tax) as well as exclusive of VAT (e.g. goods in the Bazar section), and inclusive of all fees stipulated by law, except for the costs of delivery and packaging of the goods or any other costs, which vary according to the chosen method and provider of transport and the method of payment for the order. The prices of goods remain valid for as long as they are displayed in the online shop. This provision does not preclude the conclusion of a purchase contract on individually agreed terms.

Information on the costs associated with the packaging and delivery of the goods is published in the online shop.

Any discounts on the purchase price of goods cannot be combined with each other unless the seller and the buyer agree otherwise.

Where the seller announces a price reduction on goods, it shall at the same time, in accordance with Section 12a of Act No. 634/1992 Coll., on Consumer Protection, state the lowest price at which it offered and sold the goods during the 30 days before the price reduction was granted.

Where the seller publishes customer reviews or ratings of goods, it states alongside them whether and how it ensures that the published reviews come from consumers who have actually purchased or used the goods.

The buyer hereby acknowledges that goods (electric scooters) sold in the online shop with a permissible maximum speed of more than 25 km/h and a maximum possible power of more than 1 kW are considered under the legislation of the Czech Republic to be electric bicycles (motor vehicles), the operation of which on roads is subject to the relevant legislation of the Czech Republic, whereby, in particular, these electric scooters may not be operated on roads intended exclusively for bicycles (non-motorised vehicles), i.e. cycle paths and the like. The buyer acknowledges that goods of this type are intended mainly for use on enclosed land and areas and that the buyer is responsible for compliance with the conditions of operation.

III. ORDER AND CONCLUSION OF THE PURCHASE CONTRACT

The buyer agrees to the use of means of distance communication when concluding the purchase contract. Costs incurred by the buyer when using means of distance communication in connection with the conclusion of the purchase contract (costs of internet connection, costs of telephone calls) are borne by the buyer. The costs of means of distance communication do not differ from the basic rate (in the case of both internet and telephone connection, according to the terms of the buyer's operator; the seller does not charge any additional fees; this does not apply to any contracted transport).

The buyer places an order for goods in the following ways:

  • through their customer account, if they have previously registered in the online shop,
  • by filling in the order form without registration.

The order must contain the following particulars:

  • the goods and their quantity,
  • the choice of delivery method or, where applicable, the choice of pick-up point,
  • the choice of payment method, i.e. of the method of paying the purchase price,
  • the buyer's identification details: first name, surname, e-mail address, telephone number,
  • the delivery address (street, house number, town and postcode),
  • the buyer's consent to these terms and conditions and the Privacy Policy,
  • any other information stated in the order.

Before the order is placed, the buyer is informed of the final purchase price, which comprises the sum of the prices of the selected goods, including all related services, taxes or other fees, and the price for delivery and packaging of these goods.

Before sending the order, the buyer is able to check and change the data they have entered in the order. The buyer sends the order to the seller by clicking a button which, in accordance with Section 1826a of the Civil Code, is labelled in a manner clearly indicating that sending the order entails an obligation to pay. The data stated in the order are considered correct by the seller.

Immediately after receiving the order, the seller shall:

a) send a confirmation of receipt and acceptance of the order by e-mail to the buyer's e-mail address stated under Article III(3)(d) of these terms and conditions. The current version of these terms and conditions is attached to the confirmation. The purchase contract is concluded only upon acceptance of the order by the seller. This does not apply if the buyer chooses the option of paying for the goods in cash upon collection at the business premises. In such a case, by accepting the order the seller merely confirms that the goods are ready for the buyer to collect at the business premises for 5 working days from the day on which the acceptance of the order is delivered to the buyer, unless a longer period is stated in the confirmation. In such a case, the purchase contract is concluded only upon full payment of the purchase price and collection of the goods by the buyer. This provision does not limit the seller's ability to conclude a purchase contract on individually agreed terms.

b) propose an amendment to the order to the buyer by e-mail sent to the buyer's e-mail address stated under Article III(3)(d) of these terms and conditions if the seller is prevented from confirming the order by circumstances affecting any of the particulars stated by the buyer in the order, e.g. unavailability of the goods. In this case, the purchase contract is concluded only on condition that, and at the moment when, the buyer confirms the amendment proposed by the seller under the preceding sentence by e-mail sent to the seller's e-mail address. Any change to the offer by either contracting party is deemed a new proposal for a contract, and in such a case the contract is concluded only upon full acceptance of the offer of one contracting party by the other contracting party.

c) reject the order. The buyer acknowledges that the seller is not obliged to conclude a purchase contract, in particular with persons who have previously materially breached their obligations towards the seller, or with persons who are in default in paying amounts due to the seller, or if the goods become permanently unavailable.

Depending on the nature of the order (quantity of goods, amount of the purchase price, expected transport costs), the seller is always entitled to ask the buyer for additional confirmation of the order (for example in writing or by telephone). The seller is also entitled to make the sale of goods conditional on the submission of the necessary documents and information.

All orders accepted by the seller are binding. The buyer may cancel an order until the seller's confirmation of acceptance of the order has been delivered to the buyer. The buyer may cancel the order by telephone or by e-mail, using the seller's telephone number or e-mail address stated in these terms and conditions.

In exceptional cases, the seller reserves the right not to deliver the selected goods to the buyer, or to withdraw from the purchase contract, even after the buyer has received the e-mail confirming their order, in particular if the web interface of the online shop mistakenly displayed obviously incorrect or non-standard information, especially about the selected goods, their price or delivery date, or if the goods are sold out or permanently unavailable. The withdrawal from the purchase contract then takes effect on the day on which the notice of withdrawal was delivered to the buyer at the e-mail address stated under Article III(3)(d) of these terms and conditions. In such cases, the seller undertakes to refund to the buyer the amount paid under the purchase contract.

IV. CUSTOMER ACCOUNT

On the basis of the buyer's registration in the online shop, the buyer can access their customer account. From their customer account, the buyer can order goods and track the status of their orders and shipments. The buyer may also order goods without registration.

When registering a customer account and when ordering goods, the buyer is obliged to provide all information correctly and truthfully. The buyer is obliged to update the information stated in the user account whenever it changes. The information provided by the buyer in the customer account and when ordering goods is considered correct by the seller.

Access to the customer account is secured by the buyer's e-mail address and a one-time verification code, which is sent to the buyer at this e-mail address each time they log in; the seller therefore does not store the buyer's access password. The buyer is obliged to keep confidential the information necessary for accessing their customer account and to ensure the security of their e-mail inbox. The seller is not liable for any misuse of the customer account by third parties.

The buyer is not entitled to allow third parties to use the customer account.

The seller may cancel the customer account, in particular if the buyer has not used their customer account for more than 3 months, or if the buyer breaches their obligations under the purchase contract or these terms and conditions.

The buyer acknowledges that the customer account may not be available continuously, in particular due to necessary maintenance of the seller's hardware and software, or necessary maintenance of the hardware and software of third parties.

V. PAYMENT TERMS AND DELIVERY OF GOODS

The buyer may pay the price of the goods and any costs associated with the delivery of the goods under the purchase contract in the following ways:

  • by cashless bank transfer to the seller's bank account held with Česká spořitelna, a.s. (BIC GIBACZPX): for payments in CZK, account no. 6146383339/0800 (IBAN CZ95 0800 0000 0061 4638 3339); for payments in EUR, account no. 2096498243/0800 (IBAN CZ02 0800 0000 0020 9649 8243),
  • by cashless card payment via the payment gateway,
  • in cash or by payment card upon personal collection of the goods at the business premises,
  • by cash on delivery upon receipt of the goods from the carrier, only for delivery to the Czech Republic and Slovakia.

Buyers from the other Member States of the European Union pay in EUR; the price in EUR is stated in the online shop and in the order. The seller does not charge any fees depending on the method of payment. The current range of payment methods is always shown in the ordering process of the online shop; payment methods may vary depending on the type of goods, the value of the order and the chosen delivery method.

Together with the purchase price, the buyer is obliged to pay the seller the costs associated with the packaging and delivery of the goods in the agreed amount. Unless expressly stated otherwise below, the purchase price is understood to include the costs associated with the delivery of the goods. The buyer is obliged to pay the purchase price properly and on time.

In the case of payment in cash, the purchase price is payable upon receipt of the goods. In the case of cashless payment, the purchase price is payable within 5 working days of the conclusion of the purchase contract.

In the case of payment by card via the payment gateway, the buyer follows the instructions of the relevant electronic payment provider.

In the case of cashless payment by transfer to the seller's account, the buyer is obliged to make the payment stating the payment reference (variable symbol) of the payment, and the buyer's obligation to pay the purchase price is fulfilled at the moment the relevant amount is credited to the seller's bank account.

Depending on the type of goods, the seller may require the buyer to pay a deposit, the amount of which the seller will notify to the buyer in advance after the goods have been placed in the basket. The buyer is obliged to pay the seller a deposit on the purchase price in the agreed amount, either (i) in cash to the seller, or (ii) by bank transfer no later than 5 days from the day on which the seller confirms the order of the goods, or (iii) via the payment gateway at the moment the order is sent to the seller. This deposit will be set off against the purchase price. The deposit bears no interest. Failure to pay the deposit within the above time limits constitutes a material breach of the purchase contract by the buyer, and the seller is entitled to withdraw from the purchase contract. The buyer is obliged to pay the remaining part of the purchase price of the goods no later than on the day the goods are handed over.

Payment of the purchase price before dispatch of the goods is not a deposit. The seller is entitled to require payment of the full purchase price before the goods are dispatched to the buyer. Section 2119(1) of the Civil Code shall not apply.

The seller issues to the buyer a tax document (invoice) for the payments made, which it sends in electronic form to the buyer's e-mail address or hands over together with the delivered goods.

In the case of a pre-order of goods by the buyer, the price of such goods is only provisional. The final price of the goods may therefore differ. The seller will inform the buyer of any change in price. The purchase price of the goods will be determined only after the seller has taken the goods into stock. Any difference between the provisional price paid and the purchase price will be refunded by the seller or paid by the buyer before delivery of the goods, unless the buyer decides to cancel the pre-order. For goods that can be pre-ordered, the seller reserves the right to change the delivery date, even repeatedly. In the event of a substantial change in the delivery date (i.e. 14 days), the buyer has the right to withdraw from the contract. If the circumstances on which the seller relied at the time the buyer pre-ordered the goods change to such an extent that the seller cannot reasonably be required to remain bound by the pre-order, the seller has the right to cancel the pre-order without further formality and subsequently inform the buyer thereof.

Delivery methods and delivery costs

The goods are delivered to the buyer:

  • by delivery to the address specified by the buyer in the order via a contracted carrier,
  • by delivery to the pick-up point chosen by the buyer in the order,
  • by personal collection at the seller's business premises (ECO VEHICLE SHOWROOM & SERVIS, Horní 300/77, 700 30 Ostrava-Dubina), free of charge.

Current delivery prices are always shown in the ordering process before the binding submission of the order. As of the effective date of these terms and conditions, the following applies:

Delivery method Czech Republic Slovakia
Zásilkovna: pick-up point 79 CZK 149 CZK
GLS: delivery to address 149 CZK 199 CZK
Toptrans: oversized consignments / pallet (electric scooters) 990 CZK 1 490 CZK
Personal collection at the Ostrava-Dubina business premises free of charge free of charge

For orders with a value of 5 000 CZK or more, delivery is free of charge for all of the above delivery methods to the Czech Republic and to Slovakia.

To the other Member States of the European Union, the goods are delivered to the buyer's address by the carrier DHL, and electric scooters in their original packaging via DHL Freight. The delivery price depends on the country of delivery and the weight of the consignment including packaging and, as of the effective date of these terms and conditions, is as follows (including VAT):

Country of delivery Consignment up to 50 kg (one electric scooter) 50 to 80 kg 80 to 130 kg Over 130 kg Spare parts and accessories
Germany, Austria, Poland, Hungary 99 EUR 139 EUR 179 EUR 249 EUR 19 EUR
Belgium, the Netherlands, Luxembourg, France, Italy, Denmark, Slovenia, Croatia, Romania 139 EUR 189 EUR 239 EUR 319 EUR 29 EUR
Spain, Portugal, Sweden, Finland, Ireland, Bulgaria, Estonia, Latvia, Lithuania, Greece 199 EUR 269 EUR 339 EUR 449 EUR 35 EUR

Free delivery for orders from 5 000 CZK does not apply to delivery to these countries. For delivery to the Greek islands, the carrier may charge a surcharge; in such a case, the seller will contact the buyer before dispatching the goods and the buyer may withdraw from the purchase contract without any penalty.

The delivery method is selected when ordering the goods. If the method of transport is agreed on the basis of a special request of the buyer, the buyer bears the risk and any additional costs associated with this method of transport.

The costs of delivery of the goods, depending on the method of dispatch and receipt of the goods, are stated in the buyer's order and in the seller's order confirmation.

If the goods are in stock, the seller usually dispatches them within 2 working days of the conclusion of the purchase contract or, for payments made in advance, of the payment being credited to the account. If the goods are not in stock, the seller informs the buyer of the expected delivery date. The seller informs the buyer by e-mail of the handover of the consignment to the carrier and of the tracking number of the consignment.

If the seller is obliged under the purchase contract to deliver the goods to the place specified by the buyer in the order, the buyer is obliged to take over the goods upon delivery. If, for reasons on the buyer's side, the goods have to be delivered repeatedly or in a manner other than that stated in the order, the buyer is obliged to pay the costs associated with the repeated delivery of the goods or the costs associated with the other method of delivery.

If the buyer chooses cash on delivery as the method of payment and fails to take over the goods sent cash on delivery, this constitutes a breach of the purchase contract and of these terms and conditions by the buyer. In such a case, the seller is entitled to claim reimbursement of the costs associated with the delivery of the goods.

When taking over the goods from the carrier, the buyer is obliged to check that the packaging of the goods is intact and, in the event of any defects, to notify the carrier immediately. If the packaging is found to be damaged in a way that indicates unauthorised entry into the consignment, the buyer does not have to accept the consignment from the carrier. By signing the consignment note for the carrier, the buyer agrees to take over the goods and confirms that they were delivered in the agreed quantity and quality and that the packaging of the consignment was intact.

If the buyer authorises a third party to take over the goods, the seller is not liable for loss of or damage to the goods.

The buyer acquires ownership of the goods upon payment of the full purchase price of the goods, including delivery costs, but not before taking over the goods.

Liability for accidental destruction of, damage to or loss of the goods passes to the buyer at the moment of taking over the goods or at the moment when the buyer was obliged to take over the goods but failed to do so in breach of the purchase contract.

Damage to the goods occurring after the risk of damage to the goods has passed to the buyer does not affect the buyer's obligation to pay the purchase price, unless the seller caused the damage by breaching its obligation.

Other rights and obligations of the parties relating to the transport of goods may be governed by the seller's special delivery terms, if issued by the seller.

VI. RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES

The buyer is obliged:
a) to inform the seller without undue delay of all changes and facts that have or may have a material effect on the performance of the buyer's obligations towards the seller, or on the legal status of the buyer;
b) to follow the instructions of the seller and the manufacturer for the use, charging, storage and handling of the goods, in particular the instructions given in the operating manual supplied with the goods.

The buyer agrees that the seller provides the buyer, on its website, with the information communicated to the consumer when concluding contracts outside the trader's business premises.

The buyer acknowledges that the software and other components forming the web interface of the online shop (including photographs of the goods offered) are protected by copyright. The buyer undertakes not to carry out any activity that could enable the buyer or third parties to interfere without authorisation with, or make unauthorised use of, the software or other components forming the web interface of the online shop.

When using the web interface of the online shop, the buyer is not entitled to use mechanisms, software or other procedures that could have a negative effect on the operation of the web interface of the online shop. The web interface of the online shop may be used only to the extent that is not to the detriment of the rights of the seller's other customers and that is consistent with its intended purpose.

The seller is not liable for harm suffered by the buyer primarily as a result of extraordinary situations and events that occurred independently of the seller's will and that the seller did not foresee and could not influence or overcome, in particular the effects of force majeure, or as a result of decisions of public authorities. Nor is the seller liable for harm incurred, or harm that could be incurred, in connection with or as a result of an interruption of operation and the resulting unavailability or non-provision of goods or services, of which the seller informed the buyer reasonably in advance in an appropriate manner. The seller is not liable to the buyer for harm if:
a) it was caused by unlawful conduct of the buyer or a third party,
b) it was caused by a breach of the obligations of the buyer or of persons acting in the name of or on behalf of the buyer under the purchase contract,
c) it was caused by the seller acting in accordance with the buyer's instructions and requests,
d) it was caused other than intentionally or through gross negligence,
e) the seller's breach of obligation was caused by the conduct of the buyer or by a lack of cooperation on the part of the buyer.

The provisions of this Article limiting the seller's liability shall not apply to the extent that they would conflict with mandatory provisions of consumer protection legislation.

The seller reserves the right to place on goods delivered to the buyer a label bearing the buyer's first name, surname, delivery address and telephone number. All of these data are necessary for proper delivery by the courier. After taking over the goods, the buyer is obliged to remove this label from the packaging and dispose of it in such a way that the buyer's personal data cannot be misused. If the buyer chooses to dispose of the packaging without destroying the label (by throwing it into recyclable waste), the seller is not liable for any leak of personal data.

VII. WITHDRAWAL FROM THE CONTRACT

A buyer who, as a consumer, has concluded a purchase contract outside their business activity has the right, in accordance with Section 1829(1) of the Civil Code, to withdraw from the purchase contract without giving any reason. The period for withdrawal from the contract is 14 days:

  • from the day of taking over the goods;
  • from the day of taking over the last delivery of goods, if the subject of the contract is several types of goods or the delivery of several parts;
  • from the day of taking over the first delivery of goods, if the subject of the contract is a regular repeated delivery of goods.

If the buyer has not been informed of the right to withdraw from the contract, the buyer may withdraw from the contract within one year and fourteen days from the day on which the withdrawal period started to run. However, if the buyer was informed of this right within that period, the fourteen-day withdrawal period runs from the day on which the buyer received the information.

To meet the deadline for withdrawal from the purchase contract, it is sufficient to send the withdrawal from the contract, in the form of a letter sent through a postal service provider to the address of the seller's registered office or business premises or by e-mail to info@ecovehicle.cz, before the relevant period expires. The buyer may, but does not have to, use the model form for withdrawal from the purchase contract available at www.ecovehicle.cz. Upon withdrawal, the purchase contract is cancelled from the outset.

Among other things, the buyer may not withdraw from a purchase contract:

  • for the provision of services, if they have been fully provided with the buyer's prior express consent before the expiry of the withdrawal period and the seller informed the buyer before the conclusion of the contract that in such a case the buyer does not have the right to withdraw from the contract;
  • for the supply of goods or services whose price depends on fluctuations in the financial market independent of the seller's will, which may occur during the withdrawal period;
  • for the supply of goods made to the buyer's specifications or adapted to the buyer's personal needs;
  • for the supply of goods that are liable to deteriorate rapidly, as well as goods which, after delivery, have been irreversibly mixed with other goods by reason of their nature;
  • for repairs or maintenance carried out at a place specified by the buyer at the buyer's request; however, this does not apply in the case of subsequent performance of repairs other than those requested or the supply of spare parts other than those requested;
  • for the supply of goods in sealed packaging which are not suitable for return for health protection or hygiene reasons once the buyer has broken the seal;
  • for the supply of sound or video recordings or computer software in sealed packaging if the buyer has broken the seal;
  • for the supply of newspapers, periodicals or magazines;
  • for the supply of digital content not supplied on a tangible medium, after performance has begun with the buyer's prior express consent before the expiry of the withdrawal period, and the seller informed the buyer before the conclusion of the contract that in such a case the buyer does not have the right to withdraw from the contract;
  • in other cases specified in Section 1837 of the Civil Code.

A buyer who has withdrawn from the contract is obliged to return to the seller the goods and all items provided to the buyer in connection with the delivery of the goods (send them to, or hand them over at, the address of the seller's business premises: ECO VEHICLE SHOWROOM & SERVIS, Horní 300/77, 700 30 Ostrava-Dubina) within 14 days of the day on which the withdrawal from the contract was delivered to the seller, whereby the deadline is deemed to have been met if the buyer sends the goods back before the 14 days have elapsed. If the buyer withdraws from the purchase contract, the buyer bears the costs associated with returning the goods to the seller, even if the goods cannot be returned by the usual postal route due to their nature; for oversized goods (electric scooters), these costs are estimated at a maximum of 5 000 CZK for returns from the Czech Republic and from Slovakia and, for returns from the other Member States of the European Union, at a maximum of the DHL delivery price stated in Article V for the country concerned and the weight of the consignment. The buyer is liable only for any reduction in the value of the goods resulting from handling the goods in a manner other than that necessary to become acquainted with the nature and characteristics of the goods, including their functionality.

If the buyer withdraws from the contract, the seller shall refund to the buyer, no later than 14 days from the delivery of the withdrawal to the seller, all funds, including delivery costs, received from the buyer, in the same way as the seller received them from the buyer. The seller shall refund the funds received to the buyer in a different way only if the buyer agrees to this and if it does not cause the buyer any additional costs. The buyer is responsible for the correctness of the details for the refund of funds which the buyer provides to the seller where it is not possible to refund the funds in the same way as the payment for the order was made (e.g. the customer paid in cash at the shop or to the courier, the customer's payment card has expired and the seller does not have any other payment details of the buyer), or where the seller, at its own discretion, accommodates the buyer's request to change the method of refund.

If the buyer chose a method of delivery of the goods other than the cheapest method of delivery offered by the seller, the seller shall refund to the buyer the costs of delivery of the goods in the amount corresponding to the cheapest method of delivery offered.

If the buyer withdraws from the purchase contract, the seller is not obliged to refund the funds received to the buyer before the buyer hands the goods over to the seller or proves that the buyer has sent the goods to the seller.

The buyer should return the goods complete, i.e. including all supplied accessories, with complete documentation and, if possible, in the original packaging. The seller is entitled to unilaterally set off a claim for compensation for damage to the goods against the buyer's claim for a refund of the purchase price.

If a gift is provided to the buyer together with the goods, the gift contract between the seller and the buyer is concluded subject to the condition subsequent that, if the buyer withdraws from the purchase contract, the gift contract concerning such gift ceases to have effect and the buyer is obliged to return to the seller the gift provided, together with the goods.

The seller is entitled to withdraw from the purchase contract because stocks have sold out, because the goods are unavailable, or where the manufacturer, importer or supplier of the goods has discontinued the production or import of the goods. The seller shall inform the buyer without delay via the e-mail address stated in the order and shall, within 14 days of the notice of withdrawal from the purchase contract, refund all funds, including delivery costs, received from the buyer under the contract, in the same way or, where applicable, in the manner specified by the buyer.

VIII. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE, COMPLAINTS

The seller is liable to the buyer for the goods being free from defects upon receipt. In particular, the seller is liable to the buyer that the goods:

  • correspond to the agreed description, type and quantity, as well as quality, functionality, compatibility, interoperability and other agreed characteristics;
  • are fit for the purpose for which the buyer requires them and to which the seller has agreed;
  • are supplied with the agreed accessories and instructions for use, including assembly or installation instructions;
  • are fit for the purpose for which goods of this type are usually used;
  • in quantity, quality and other characteristics, including durability, functionality and safety, correspond to the usual characteristics of goods of the same type that the buyer can reasonably expect, also taking into account public statements made by the seller or the manufacturer;
  • are supplied with such accessories, including packaging and instructions for use, as the buyer can reasonably expect;
  • correspond in quality or workmanship to the sample or model that the seller provided to the buyer before the conclusion of the contract;
  • comply with the requirements of legal regulations.

The buyer may notify a defect that becomes apparent in the goods within two years of receipt. If a defect becomes apparent within one year of receipt, the goods are presumed to have been defective upon receipt, unless the nature of the goods or of the defect precludes this. This period does not run for the time during which the buyer cannot use the goods, provided that the buyer notified the defect justifiably.

The buyer's right arising from defective performance is established by a defect that the goods have when the risk of damage passes to the buyer, even if it becomes apparent only later. The buyer's right is also established by a defect arising later which the seller caused by breaching its obligation.

The provisions set out in the preceding paragraphs do not apply: in the case of goods sold at a lower price, to the defect for which the lower price was agreed; to wear and tear of the goods caused by their normal use; in the case of used goods, to a defect corresponding to the degree of use or wear and tear that the goods had upon receipt by the buyer; or where this follows from the nature of the goods. For used goods (e.g. goods in the Bazar section), the parties may shorten the period for notifying a defect to one year from receipt. The buyer is not entitled to rights arising from defective performance if the buyer caused the defect themselves, nor in the case of defects caused by normal wear and tear, improper use, storage or charging of the goods contrary to the instructions, mechanical damage, unprofessional assembly or interference with the goods.

Buyer's rights arising from defective performance. If the goods have a defect, the buyer may request that it be remedied. At the buyer's choice, the buyer may request delivery of new goods without defects or repair of the goods, unless the chosen method of remedying the defect is impossible or disproportionately expensive compared with the other; this is assessed in particular with regard to the significance of the defect, the value that the goods would have without the defect, and whether the defect can be remedied by the other method without significant inconvenience to the buyer. The seller may refuse to remedy the defect if this is impossible or disproportionately expensive, in particular with regard to the significance of the defect and the value that the goods would have without the defect.

The buyer may request a reasonable reduction of the purchase price or withdraw from the contract if:

  • the seller has refused to remedy the defect or has not remedied it in accordance with legal regulations;
  • the defect recurs;
  • the defect constitutes a material breach of the contract; or
  • it is evident from the seller's statement or from the circumstances that the defect will not be remedied within a reasonable time or without significant inconvenience to the buyer.

The buyer may not withdraw from the contract if the defect in the goods is insignificant; a defect is presumed not to be insignificant. If the buyer withdraws from the contract, the seller shall refund the purchase price to the buyer without undue delay after receiving the goods or after the buyer proves to the seller that the buyer has sent the goods.

The seller shall remedy the defect within a reasonable time after it has been notified, so as not to cause significant inconvenience to the buyer, taking into account the nature of the goods and the purpose for which the buyer bought the goods. To remedy the defect, the seller shall take over the goods at its own expense.

Making a complaint. Rights arising from liability for defects in the goods are exercised with the seller in writing by post, by e-mail to info@ecovehicle.cz or in person at the address of the business premises ECO VEHICLE SHOWROOM & SERVIS, Horní 300/77, 700 30 Ostrava-Dubina, without undue delay after the deficiency has been discovered. The seller is obliged to accept a complaint at any of its business premises where acceptance of the complaint is possible, or also at its registered office or place of business. When making a complaint, the buyer proves the origin of the goods by presenting the invoice or the accepted order; if the buyer is unable to present these documents, the buyer is obliged to prove the conclusion of the purchase contract in another verifiable manner. In the complaint, the buyer states in particular their contact details, a description of the fault and the requested method of handling the complaint.

When a complaint is made, the seller is obliged to issue to the buyer a written confirmation stating when the buyer exercised the right, what the content of the complaint is and what method of handling the complaint the buyer requests, as well as a confirmation of the date and method of handling the complaint, including confirmation of the repair carried out and its duration, or a written justification for rejecting the complaint.

The seller or an employee authorised by the seller shall decide on the complaint immediately, or in complex cases within three working days. This period does not include the time, appropriate to the type of product or service, required for an expert assessment of the defect. The complaint, including the remedy of the defect, must be handled and the buyer must be informed thereof no later than 30 days from the day on which the complaint was made, unless the seller and the buyer agree on a longer period. Failure to meet this deadline is deemed a material breach of the contract and the buyer has the right to withdraw from the purchase contract or to request a reasonable price reduction.

In the case of a justified complaint, the buyer is entitled to reimbursement of the costs reasonably incurred in connection with making the complaint. However, if the buyer does not exercise the right to reimbursement within one month after the expiry of the period within which the defect must be notified, the court will not grant the right if the seller objects that the right to reimbursement was not exercised in time.

The buyer acknowledges that, where gifts are provided together with the goods, the right arising from a defect may be exercised within two years only for the goods sold, but not for the gifts provided together with the goods. For these gifts, the buyer may exercise rights arising from defective performance only within 14 days of the day of taking over the goods.

Quality guarantee. If the seller or the manufacturer has undertaken to provide a quality guarantee for the goods, it thereby undertakes that the goods will remain fit for use for their usual purpose or will retain their usual characteristics for a certain period of time. Stating the guarantee period or the period of usability of the goods on the packaging, in the instructions or in advertising has the same effect. The guarantee period runs from the handover of the goods to the buyer; if the goods were dispatched under the contract, it runs from the arrival of the goods at their destination. The buyer has no right under the guarantee if the defect was caused by an external event after the risk of damage to the goods passed to the buyer. The scope of any guarantee provided by the manufacturer and its conditions are stated in the guarantee certificate or in the documentation supplied with the goods.

The rights and obligations of the contracting parties regarding rights arising from defective performance are governed by Sections 1914 to 1925, Sections 2099 to 2117 and Sections 2161 to 2174b of the Civil Code and by Act No. 634/1992 Coll., on Consumer Protection.

The buyer is obliged to collect the goods that were the subject of the complaint within 30 days of the day on which the buyer was informed that the complaint had been handled; after this period, the seller is entitled to charge a storage fee of 50 CZK for each day or part thereof. If the buyer does not collect the goods from a handled complaint within 12 months of the day on which the buyer was informed that it had been handled, the seller reserves the right to sell the goods and use the proceeds to cover the storage fee.

Other rights and obligations of the parties relating to the seller's liability for defects may be governed by the seller's complaints procedure.

IX. DELIVERY OF CORRESPONDENCE

The contracting parties may deliver all written correspondence to each other by electronic mail.

The buyer delivers correspondence to the seller at the e-mail address stated in these terms and conditions. The seller delivers correspondence to the buyer at the e-mail address stated in the buyer's customer account or in the order.

The buyer acknowledges that they are obliged to provide their personal data (during registration, in their customer account, when placing an order from the web interface of the shop) correctly and truthfully, and that they are obliged to inform the seller without undue delay of any change in their personal data.

Personal data will be processed in electronic form by automated means or in printed form by non-automated means.

The buyer confirms that the personal data provided are accurate and that the buyer has been informed that the provision of the data is voluntary.

The buyer declares that before sending the order they received the Privacy Policy of Eco Vehicle s.r.o. and familiarised themselves with it, including the information on their rights in connection with the processing of personal data by the seller. The buyer also declares that they have been informed that the current version of the Privacy Policy can be obtained at any time on the seller's website.

Within the meaning of Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, as amended, the buyer consents to the sending of commercial communications by the seller to the buyer's electronic address or telephone number. Consent may be withdrawn at any time, using the unsubscribe link in each commercial communication or by a message to info@ecovehicle.cz. The seller fulfils its information obligation towards the buyer within the meaning of Article 13 of the General Data Protection Regulation relating to the processing of the buyer's personal data for the purpose of sending commercial communications by means of a separate document.

XIII. FINAL PROVISIONS

Legal relationships arising between the buyer and the seller are governed by the laws of the Czech Republic, unless agreed otherwise. The contracting parties have agreed that their mutual rights and obligations not governed by this contract are governed by the relevant provisions of Act No. 89/2012 Coll., the Civil Code. If the relationship established by the purchase contract contains an international element, the parties agree that the relationship is governed by the law of the Czech Republic. The buyer hereby assumes the risk of a change in circumstances within the meaning of Section 1765(2) of the Civil Code.

A buyer who is a business agrees that the seller is entitled to set off the seller's due monetary claim against the buyer against any monetary claim of the buyer against the seller, regardless of the currency of the claim and the legal relationship from which it arises, including against claims of the buyer that are not yet due. A buyer who is a business is not entitled, without the seller's express consent, to set off any due monetary claim of the buyer against the seller against any monetary claim of the seller against the buyer, regardless of the currency of the claim, its maturity and the legal relationship from which it arises.

The buyer agrees that the seller is entitled to assign the purchase contract to a third party; if the buyer is a consumer, the buyer's consent is required for the assignment.

If any provision of these terms and conditions or any part thereof is found to be invalid, ineffective or unenforceable, this shall not affect the validity, effectiveness or enforceability of the other provisions of the terms and conditions. In such a case, the legal relationships to which such invalid, ineffective or unenforceable provision applied or was intended to apply shall be governed by those provisions of the relevant legislation that most closely correspond to the intention of the parties arising from such provision.

The purchase contract, including the terms and conditions, is archived by the seller in electronic form and is not accessible to uninvolved third parties. Upon request, the seller will send the buyer the details of the purchase contract.
